Judicial restraint is the refusal to exercise judicial review in deference to the process of ordinary politics.

Here are some Supreme Court justices who practiced it:

  • Oliver Wendell Holmes, Jr. (served 1902–1932)
  • Louis Brandeis (served 1916–1939)
  • Felix Frankfurter (served 1939–1962)
